1.1. Welcome
Welcome to Ondjila Safaris Namibia CC.
Thank you for entrusting us with the privilege of planning your Namibian safari experience. Every journey we design is individually curated to showcase the extraordinary landscapes, wildlife, cultures, and hospitality that make Namibia one of Africa's most captivating destinations.
At Ondjila Safaris Namibia, we believe luxury extends beyond exceptional accommodation and exclusive experiences, it lies in meticulous planning, seamless execution, personal service, and genuine care for every guest throughout their journey.
These Terms and Conditions have been carefully prepared to ensure transparency, establish a clear understanding between both parties, and protect the interests of both our valued guests and Ondjila Safaris Namibia CC. They govern all quotations, reservations, bookings, payments, cancellations, amendments, and travel services arranged by the Company.
We encourage all guests to read this document carefully before confirming a reservation. Should you require clarification regarding any provision contained herein, our team will gladly provide further explanation.
By confirming a booking, paying a deposit, or making full payment, you acknowledge that you have read, understood, and accepted these Terms and Conditions in their entirety.
1.2. Company Philosophy
Ondjila Safaris Namibia CC is dedicated to creating authentic, tailor-made safari experiences that celebrate Namibia's exceptional natural heritage while supporting sustainable tourism and responsible conservation.
We proudly collaborate with carefully selected lodges, camps, charter operators, guides, transport providers, and conservation partners who share our commitment to excellence, environmental stewardship, ethical tourism, and exceptional guest service.
Our objective is to deliver memorable journeys that exceed expectations while promoting respect for Namibia's people, wildlife, landscapes, and cultural diversity.
1.3. Definitions
For the purpose of these Terms and Conditions, unless the context indicates otherwise, the following definitions shall apply:
Company
Refers to Ondjila Safaris Namibia CC, including its owners, directors, employees, representatives, consultants, guides, contractors, and authorised agents.
Guest
Refers to the individual making the booking, every traveller included within that booking, and any person acting on behalf of those travellers.
Lead Guest
The individual responsible for making the reservation and communicating with the Company. The Lead Guest confirms that they have authority to accept these Terms and Conditions on behalf of all travellers included within the booking.
Booking
The confirmed reservation for any itinerary, accommodation, transport, charter flight, guided activity, excursion, or other travel-related service arranged by the Company.
Quotation
A written proposal prepared by the Company outlining the proposed itinerary, services, estimated pricing, and applicable booking conditions.
Itinerary
The complete travel programme prepared by the Company, including accommodation, transport, activities, meals, flights, transfers, excursions, and other confirmed arrangements.
Supplier
Any independent third-party service provider contracted to deliver services forming part of the itinerary, including but not limited to:
- Lodges
- Hotels
- Charter operators
- Scheduled airlines
- Road transfer companies
- Vehicle rental companies
- Activity providers
- Restaurants
- Conservation organisations
- Tour guides
- Tourism establishments
Any service arranged by the Company on behalf of the Guest, including accommodation, transportation, charter flights, scheduled flights, guided safaris, activities, excursions, meals, permits, park entrance fees, and related travel services.
Business Day
Any day excluding Saturdays, Sundays and officially recognised public holidays in the Republic of Namibia.
Force Majeure
Any circumstance beyond the reasonable control of the Company or its Suppliers, including but not limited to:
- Natural disasters
- Floods
- Wildfires
- Drought
- Epidemics
- Pandemics
- Government restrictions
- Political unrest
- Terrorism
- Civil disturbance
- Border closures
- Labour disputes
- Airline disruptions
- Mechanical failures
- Extreme weather
- Wildlife incidents
- Any event that materially affects the delivery of booked services.
1.4. Scope of Agreement
These Terms and Conditions constitute the contractual agreement between Ondjila Safaris Namibia CC and the Guest.
They apply to every enquiry, quotation, reservation, booking, itinerary, invoice, amendment, cancellation, payment and travel arrangement facilitated by the Company unless otherwise agreed in writing.
Any additional conditions imposed by independent Suppliers shall remain applicable and form part of the overall booking agreement.
Where a Supplier's conditions differ from those of the Company, the Supplier's conditions shall apply only to the services provided by that Supplier.
1.5. Acceptance of the Booking Agreement
Travel Services
A booking shall be deemed accepted when any one of the following occurs:
- A written confirmation of the booking is provided by the Guest.
- A deposit is paid.
- Full payment is received.
- The Company issues a confirmation invoice following acceptance of the quotation.
The Lead Guest confirms that they have obtained the consent of every traveller included within the reservation and accepts these Terms and Conditions on behalf of all members of the travelling party.
No person included within the booking may claim ignorance of these Terms and Conditions once a booking has been confirmed.
2.1. Quotations
All quotations issued by Ondjila Safaris Namibia CC are prepared in good faith based on the availability, supplier rates, taxes, exchange rates, government levies, fuel surcharges, park fees, and operational costs applicable on the date of issue.
Unless expressly stated otherwise, quotations remain valid for fourteen (14) calendar days from the date of issue.
Quotations are subject to change without prior notice should supplier pricing, availability, exchange rates, government taxes, aviation fuel costs, conservation levies, or other external factors change before confirmation.
Availability cannot be guaranteed until the required deposit has been received and all services have been confirmed by the respective Suppliers.
The Company reserves the right to substitute accommodation or services of a similar standard where circumstances beyond its control require such changes.
2.2. Reservations
Reservations are confirmed only after:
- the required deposit has been received;
- availability has been secured with all relevant Suppliers; and
- the Company has issued written confirmation.
Until confirmation has been issued, no accommodation, charter flight, scheduled flight, activity or service shall be regarded as guaranteed.
The Company cannot accept responsibility where requested services become unavailable before confirmation due to limited availability or supplier demand.
2.3. Deposits
A non-refundable 25% deposit may be required to secure a reservation.
The required deposit amount will be specified in the quotation or invoice and may vary depending on the policies of individual Suppliers.
Certain luxury lodges, exclusive-use properties, charter operators, scheduled airlines, or special events may require higher deposits or immediate full payment.
Failure to pay the required deposit by the specified due date may result in the automatic cancellation of the provisional reservation without further notice.
2.4. Final Payment
Unless otherwise agreed in writing, full payment must be received no later than thirty (30) days prior to the commencement of travel.
Certain Suppliers may require earlier payment deadlines, and these will be communicated in writing.
Bookings made within thirty (30) days of departure may require immediate full payment.
Travel documentation, vouchers, confirmations, and final itineraries will only be issued once all outstanding amounts have been received in cleared funds.
2.5. Pricing
All prices are quoted in the currency specified on the quotation.
Unless expressly stated otherwise, quotations include only those services specifically detailed within the itinerary.
Items not expressly included shall be deemed excluded.
Additional costs may include, but are not limited to:
- International airfare
- Visa fees
- Passport costs
- Comprehensive travel insurance
- Optional activities
- Premium beverages
- Laundry
- Gratuities
- Personal expenses
- Telephone charges
- Medical expenses
- Additional meals
- Items of a personal nature
The Company reserves the right to amend pricing before final confirmation where increases arise from exchange rate fluctuations, government taxes, supplier tariffs, fuel surcharges, aviation costs, conservation levies, or circumstances beyond its reasonable control.
Once full payment has been received and all services confirmed, no further price adjustments shall apply unless requested by the Guest or required due to changes beyond the Company's control.
2.6. Payment Methods
Payments may be made by Electronic Funds Transfer (EFT), approved electronic payment platforms, or any other payment method accepted by the Company.
Bank charges, foreign exchange fees, credit card charges, intermediary banking costs, and international transfer fees remain the responsibility of the Guest unless otherwise agreed.
Payments shall only be regarded as received once cleared funds reflect in the Company's designated bank account.
The Company reserves the right to suspend or cancel reservations where payments are delayed, incomplete, reversed, or declined.
3.1. Amendments Requested by the Guest
Ondjila Safaris Namibia CC recognises that travel plans may occasionally change. Wherever reasonably possible, we will endeavour to accommodate requests to amend confirmed itineraries. However, all amendments remain subject to availability and the policies of our Suppliers.
Any request to amend a confirmed booking must be submitted in writing by the Lead Guest.
Requested amendments may include, but are not limited to:
- Travel dates
- Accommodation
- Charter or scheduled flights
- Guest names
- Number of travellers
- Activities and excursions
- Transfer arrangements
- Vehicle requirements
- Dietary or special service requests
An amendment is not confirmed until written acceptance has been issued by the Company.
Please note that amendments may result in revised pricing due to changes in seasonal rates, accommodation availability, airline fares, fuel surcharges, exchange rates, conservation levies or Supplier policies.
The Company reserves the right to charge a reasonable administration fee for processing amendments, in addition to any fees or penalties imposed by Suppliers.
3.2. Amendments Initiated by the Company
While every effort is made to operate itineraries exactly as confirmed, circumstances beyond our reasonable control may occasionally require changes.
Should it become necessary to amend any aspect of a confirmed itinerary, Ondjila Safaris Namibia CC reserves the right to substitute services with alternatives of comparable quality and value.
Such changes may include:
- Accommodation substitutions
- Alternative guides
- Different safari vehicles
- Revised activity schedules
- Alternative charter aircraft
- Modified transfer arrangements
- Adjusted routing due to weather or operational requirements
Where a significant amendment becomes necessary before travel, the Guest will be informed as soon as reasonably practicable.
Should a substitute service be of a materially lower standard and no acceptable alternative can be offered, the Company will endeavour to provide an appropriate refund for the affected portion of the itinerary where applicable.
The Company shall not be liable for any indirect or consequential losses resulting from operational amendments made in good faith.
3.3. Guest Cancellations
Any cancellation of a confirmed booking must be submitted in writing by the Lead Guest.
The effective cancellation date shall be the date on which written notification is received by the Company during normal business hours.
Cancellation charges become applicable immediately upon cancellation and are calculated according to the cancellation policies of both Ondjila Safaris Namibia CC and the relevant Suppliers.
As many of our preferred lodges, charter operators and luxury properties operate with limited inventory, cancellation penalties can be substantial, particularly during peak travel periods.
Cancellation charges may increase progressively as the scheduled departure date approaches.
Where multiple Suppliers are involved, each Supplier may apply its own cancellation policy in addition to the Company's administration charges.
The Company will provide a detailed breakdown of applicable cancellation costs upon request.
3.4. Non-Arrival and No-Show
Failure to arrive for any booked service without prior written notification shall be regarded as a "No-Show."
This includes, but is not limited to:
- Missing scheduled flights
- Missing charter departures
- Failure to arrive at accommodation
- Failure to participate in scheduled activities
No-Show reservations are generally non-refundable.
Many Suppliers will regard a booking as cancelled immediately following a No-Show, which may result in the automatic cancellation of all remaining services forming part of the itinerary.
Guests are strongly encouraged to notify the Company immediately should delays occur that may affect their travel arrangements.
3.5. Refund Policy
Refunds are always subject to the terms and conditions of the relevant Suppliers.
Ondjila Safaris Namibia CC acts primarily as an intermediary between Guests and independent service providers.
Where refunds are approved by Suppliers, the Company will facilitate the refund process as efficiently as possible.
Refund processing times vary significantly depending on the Supplier and may take several weeks or months following receipt of the applicable funds.
The Company cannot guarantee the amount or timing of any refund until confirmation has been received from the relevant Supplier.
Administration fees charged by the Company for professional services already rendered are non-refundable.
Bank charges, currency conversion costs and payment processing fees may also be deducted where applicable.
3.6. Services Not Utilised
No refund shall be payable for any unused accommodation, transfers, meals, activities, excursions, park fees or transportation where the Guest voluntarily elects not to utilise confirmed services.
Likewise, no refund shall be payable where services cannot be utilised due to:
- Late arrival
- Missed flights
- Personal choice
- Illness
- Failure to obtain travel documentation
- Failure to comply with immigration requirements
- Failure to comply with health regulations
- Personal scheduling decisions
Guests are encouraged to obtain comprehensive travel insurance covering such eventualities.
4.1. Third-Party Suppliers
Ondjila Safaris Namibia CC carefully selects Suppliers based on their reputation, professionalism and quality of service.
These Suppliers operate as independent businesses and are not employees, partners or agents of Ondjila Safaris Namibia CC.
Our Suppliers may include:
- Luxury safari lodges
- Boutique hotels
- Charter aviation companies
- Scheduled airlines
- Vehicle rental companies
- Transfer operators
- Independent guides
- Activity providers
- Restaurants
- Conservation organisations
While every effort is made to work only with reputable partners, the Company cannot accept responsibility for acts, omissions, negligence, insolvency or operational failures of independent Suppliers.
4.2. Supplier Changes and Operational Disruptions
Travel services may occasionally be affected by circumstances beyond the Company's reasonable control.
These circumstances may include:
- Weather conditions
- Flooding
- Road closures
- Mechanical breakdowns
- Aviation restrictions
- Wildlife activity
- Government directives
- Labour disputes
- Conservation requirements
- Infrastructure failures
Should such circumstances arise, the Company will make every reasonable effort to minimise disruption and provide suitable alternatives where possible.
Any additional costs arising from circumstances outside the Company's control shall remain the responsibility of the Guest unless otherwise agreed in writing.
5.1. Responsibility for Travel Documentation
Guests are solely responsible for ensuring that all travel documentation is valid and accurate.
This includes, but is not limited to:
- Passports
- Visas
- Travel insurance documentation
- Flight tickets
- Park permits
The Company cannot accept responsibility for denied boarding, refused entry, deportation, missed travel arrangements or financial losses resulting from incomplete, incorrect or expired documentation.
5.2. Road Transfers and Ground Transportation
Road transfers form an integral part of many Namibian safari itineraries.
Travel times provided within itineraries are estimates only and may vary due to:
- Weather conditions
- Road maintenance
- Wildlife crossings
- Traffic
- Mechanical issues
- Safety considerations
Drivers reserve the right to adjust departure times or routes where necessary to ensure passenger safety.
The Company cannot be held responsible for delays caused by road conditions or circumstances beyond its reasonable control.
5.3. Self-Drive Itineraries
Where Guests elect to undertake self-drive safaris, they accept full responsibility for the safe operation of the hired vehicle.
Guests must ensure that they:
- Hold a valid driving licence recognised in Namibia.
- Comply with all Namibian road traffic legislation.
- Observe speed limits.
- Exercise caution on gravel roads.
- Avoid driving after dark wherever possible.
The Company accepts no responsibility for accidents, traffic offences, vehicle damage, tyre damage, theft or personal injury associated with self-drive travel. Vehicle rental agreements remain solely between the Guest and the vehicle rental company.
5.4. Guided Safaris and Excursions
Guests agree to follow all instructions provided by professional guides, pilots, lodge staff and activity operators at all times.
Guides are authorised to modify or cancel activities where necessary to ensure:
- Guest safety
- Wildlife welfare
- Environmental protection
- Compliance with conservation regulations
Such decisions are final and made in the best interests of all participants.
No refund shall be due where an activity is shortened, modified or cancelled for legitimate safety reasons.
5.5. Wildlife Encounters
Guests acknowledge that safari experiences involve close proximity to free-roaming wild animals in their natural habitat.
While every reasonable precaution is taken, wildlife behaviour is inherently unpredictable.
Participation in game drives, walking safaris, boat cruises, photographic excursions and other wildlife activities is undertaken entirely at the Guest's own risk.
Guests agree to:
- Remain inside safari vehicles unless instructed otherwise.
- Follow guide instructions immediately.
- Never feed wildlife.
- Maintain appropriate noise levels.
- Respect animal behaviour and natural habitats.
- Never attempt to approach or provoke wildlife.
Failure to comply with guide instructions may result in immediate removal from the activity without refund.
5.6. Walking Safaris
Walking safaris offer an immersive wilderness experience and involve inherent risks associated with travelling on foot in areas inhabited by wild animals.
Participation is voluntary.
Guests confirm that they:
- Are physically capable of participating.
- Have disclosed any relevant medical conditions.
- Will comply with all safety instructions.
- Accept the inherent risks associated with wilderness activities.
The decision of the professional guide regarding the continuation, modification or termination of a walking safari is final.
5.7. Scenic Flights and Helicopter Excursions
Scenic flights and helicopter excursions are subject to:
- Weather conditions
- Aircraft availability
- Civil aviation regulations
- Pilot discretion
- Operational safety requirements
Pilots retain absolute authority regarding the operation of any flight.
Flights may be delayed, shortened or cancelled where safety considerations require.
The Company shall not be liable for inconvenience arising from such operational decisions.
5.8. Guest Conduct During Safari
To preserve the exclusive experience enjoyed by all Guests, Ondjila Safaris Namibia CC expects courteous and respectful conduct throughout every journey.
Guests shall refrain from behaviour that:
- Endangers themselves or others.
- Disturbs wildlife.
- Damages the environment.
- Causes offence to local communities.
- Disrupts other Guests.
- Damages accommodation or equipment.
The Company reserves the right to terminate services immediately where a Guest's conduct is considered dangerous, unlawful, abusive or disruptive.
Any resulting costs shall remain the responsibility of the Guest.
5.9. Conservation and Environmental Responsibility
Ondjila Safaris Namibia CC is committed to responsible tourism and the long-term conservation of Namibia's natural heritage.
Guests are encouraged to support this commitment by:
- Respecting protected areas.
- Remaining on designated roads and tracks.
- Avoiding littering.
- Conserving water and energy.
- Respecting local customs and traditions.
- Supporting ethical wildlife viewing practices.
- Refraining from purchasing products derived from endangered species.
Our commitment to sustainable tourism forms part of every safari experience we design.
5.10. Photography and Drone Usage
Guests are welcome to photograph Namibia's extraordinary landscapes and wildlife for personal use.
Commercial photography or filming may require prior approval from the relevant authorities, conservation agencies or property owners.
The operation of drones is prohibited in many protected areas, national parks, private reserves and around wildlife.
Guests are solely responsible for obtaining any required permits and complying with applicable aviation and conservation legislation.
The Company accepts no responsibility for confiscated equipment, fines or penalties arising from unauthorised drone use.
5.11. Special Requests
Ondjila Safaris Namibia CC will make every reasonable effort to communicate special requests to Suppliers.
These may include:
- Dietary requirements
- Honeymoon arrangements
- Accessibility requirements
- Medical considerations
- Celebration events
- Preferred room configurations
While every effort will be made to accommodate such requests, they cannot be guaranteed and shall not constitute a contractual obligation unless confirmed in writing by the relevant Supplier.
5.12. Passports and Travel Documentation
It is the sole responsibility of each Guest to ensure that they are in possession of all valid travel documentation required for their journey.
This includes, but is not limited to:
- A valid passport with the required validity period.
- Sufficient blank visa pages.
- Required visas and transit visas.
- Proof of onward travel where applicable.
- Vaccination certificates.
- Health declarations.
- Travel insurance documentation.
- Any permits required by the destination country.
As passport and immigration requirements vary by nationality and destination, Guests are advised to verify the latest entry requirements with the relevant embassies or immigration authorities well in advance of travel.
Ondjila Safaris Namibia CC accepts no responsibility for any loss, expense, denied boarding, refused entry, deportation or interruption to travel resulting from incomplete, incorrect or expired documentation.
5.13. Visa Requirements
Visa regulations are subject to change without notice and remain the responsibility of the respective government authorities.
Where requested, the Company may provide general guidance regarding visa requirements; however, such information is supplied for convenience only and should not be regarded as legal or immigration advice.
Guests remain solely responsible for:
- Determining whether visas are required.
- Completing visa applications.
- Paying applicable visa fees.
- Ensuring visas are valid for the intended itinerary.
- Obtaining all required travel authorisations prior to departure.
The Company shall not be liable for delays, refusals or financial losses arising from visa-related matters.
6.1. Scheduled Airline Services
Where scheduled domestic, regional or international airline services form part of the Guest's itinerary, Ondjila Safaris Namibia CC acts solely as a booking intermediary on behalf of the Guest.
All airline reservations are subject to the individual airline's Conditions of Carriage, fare rules, baggage policies and operational procedures.
The Company cannot guarantee:
- Flight schedules
- Aircraft types
- Seat allocations
- On-board services
- Flight durations
- Airline operational decisions
Airlines reserve the right to alter schedules, aircraft types, departure times and routes without prior notice.
The Company shall not be held liable for any losses, delays, missed connections or additional expenses resulting from such changes.
Guests are encouraged to reconfirm all flight details directly with the airline prior to departure.
6.2. Charter Flights
Many luxury Namibian safari itineraries include privately operated or scheduled charter aircraft servicing remote destinations.
Guests acknowledge that charter aviation operates under unique conditions and may be affected by:
- Weather conditions
- Airstrip accessibility
- Passenger weight limitations
- Aircraft availability
- Air traffic control restrictions
- Operational safety requirements.
Charter operators reserve the absolute right to delay, postpone or cancel flights where safety considerations require such action.
The safety of passengers and crew shall always take precedence over scheduled departure times.
6.3. Charter Flight Baggage Restrictions
Due to aircraft weight and balance limitations, strict baggage restrictions apply to most charter flights operating within Namibia.
Unless otherwise advised:
- Soft-sided luggage is required.
- Hard-shell suitcases may not be accepted.
- Individual baggage weight restrictions apply.
- Hand luggage limitations apply.
- Excess baggage may need to be transported separately at additional cost.
Guests are responsible for complying with baggage limitations communicated before departure.
The Company accepts no responsibility for delays or additional expenses arising from excess or unsuitable baggage.
6.4. Flight Delays and Missed Connections
While every effort is made to coordinate travel arrangements efficiently, the Company cannot accept responsibility for delays caused by airlines, weather conditions, airport congestion or operational circumstances beyond its control.
Where practical, the Company will assist Guests in rearranging affected services.
However, any resulting costs, including but not limited to:
- Additional accommodation
- Meals
- Ground transportation
- Alternative flights
- Charter services
- Change fees
shall remain the responsibility of the Guest unless specifically covered by travel insurance or accepted by the responsible Supplier.
6.5. Road Transfers and Ground Transportation
Road transfers form an integral part of many Namibian safari itineraries.
Travel times provided within itineraries are estimates only and may vary due to:
- Weather conditions
- Road maintenance
- Wildlife crossings
- Traffic
- Mechanical issues
- Safety considerations
Drivers reserve the right to adjust departure times or routes where necessary to ensure passenger safety.
The Company cannot be held responsible for delays caused by road conditions or circumstances beyond its reasonable control.
6.6. Self-Drive Itineraries
Where Guests elect to undertake self-drive safaris, they accept full responsibility for the safe operation of the hired vehicle.
Guests must ensure that they:
- Hold a valid driving licence recognised in Namibia.
- Comply with all Namibian road traffic legislation.
- Observe speed limits.
- Exercise caution on gravel roads.
- Avoid driving after dark wherever possible.
The Company accepts no responsibility for accidents, traffic offences, vehicle damage, tyre damage, theft or personal injury associated with self-drive travel. Vehicle rental agreements remain solely between the Guest and the vehicle rental company.
6.7. Arrival in Namibia
Guests are requested to provide their complete international and domestic flight details no later than twenty-one (21) days prior to arrival to enable the Company to coordinate transfers, meet-and-greet services and any onward travel arrangements.
Should flight schedules change after final documentation has been issued, Guests are requested to notify Ondjila Safaris Namibia CC immediately.
Failure to communicate flight changes may result in missed transfers or additional costs, for which the Company cannot be held responsible.
6.8. Meet and Greet Services
Where included within the confirmed itinerary, Guests will be met by an authorised representative of Ondjila Safaris Namibia CC or an appointed service provider.
Guests should carefully review their final travel documentation for meeting locations, emergency contact details and transfer instructions.
Should Guests experience any difficulty locating their representative, they are requested to contact the Company's emergency contact number immediately.
6.9. Emergency Contact
The Company provides an emergency contact number for genuine travel emergencies occurring outside normal office hours.
Examples include:
- Missed transfers
- Flight disruptions
- Medical emergencies
- Vehicle breakdowns
- Safety concerns
The emergency number should not be used for routine enquiries, quotation requests or itinerary amendments.
Office-related matters will be attended to during normal business hours.
6.10. Safari Vehicles
Safari vehicles used throughout Namibia are specifically selected for comfort, reliability and optimal wildlife viewing.
Vehicle specifications may vary depending on:
- Destination
- Road conditions
- Number of Guests
- Seasonal requirements
- Type of safari
Guests are requested to treat all vehicles with respect.
Smoking and vaping inside safari vehicles are prohibited unless specifically authorised by the guide.
The Company reserves the right to recover the costs of repairing any damage caused intentionally or through negligence.
7.1. Guided Safaris and Excursions
Guests agree to follow all instructions provided by professional guides, pilots, lodge staff and activity operators at all times.
Guides are authorised to modify or cancel activities where necessary to ensure:
- Guest safety
- Wildlife welfare
- Environmental protection
- Compliance with conservation regulations
Such decisions are final and made in the best interests of all participants.
No refund shall be due where an activity is shortened, modified or cancelled for legitimate safety reasons.
7.2. Wildlife Encounters
Guests acknowledge that safari experiences involve close proximity to free-roaming wild animals in their natural habitat.
While every reasonable precaution is taken, wildlife behaviour is inherently unpredictable.
Participation in game drives, walking safaris, boat cruises, photographic excursions and other wildlife activities is undertaken entirely at the Guest's own risk.
Guests agree to:
- Remain inside safari vehicles unless instructed otherwise.
- Follow guide instructions immediately.
- Never feed wildlife.
- Maintain appropriate noise levels.
- Respect animal behaviour and natural habitats.
- Never attempt to approach or provoke wildlife.
Failure to comply with guide instructions may result in immediate removal from the activity without refund.
7.3. Walking Safaris
Walking safaris offer an immersive wilderness experience and involve inherent risks associated with travelling on foot in areas inhabited by wild animals.
Participation is voluntary.
Guests confirm that they:
- Are physically capable of participating.
- Have disclosed any relevant medical conditions.
- Will comply with all safety instructions.
- Accept the inherent risks associated with wilderness activities.
The decision of the professional guide regarding the continuation, modification or termination of a walking safari is final.
7.4. Scenic Flights and Helicopter Excursions
Scenic flights and helicopter excursions are subject to:
- Weather conditions
- Aircraft availability
- Civil aviation regulations
- Pilot discretion
- Operational safety requirements
Pilots retain absolute authority regarding the operation of any flight.
Flights may be delayed, shortened or cancelled where safety considerations require.
The Company shall not be liable for inconvenience arising from such operational decisions.
8.1. Guest Responsibilities
Guests are expected to conduct themselves respectfully and responsibly throughout their journey.
Guests agree to:
- Follow the lawful instructions of guides, pilots and lodge staff.
- Respect Namibia's wildlife and natural environment.
- Comply with conservation regulations.
- Treat local communities with courtesy and respect.
- Refrain from behaviour that may endanger themselves or others.
- Respect the property of accommodation establishments and Suppliers.
Where a Guest's conduct poses a danger to others, causes disruption or results in damage to property, the Company reserves the right to terminate affected services without refund. The Guest shall remain liable for any damage, loss, legal costs or expenses arising from their conduct.
8.2. Guest Conduct During Safari
To preserve the exclusive experience enjoyed by all Guests, Ondjila Safaris Namibia CC expects courteous and respectful conduct throughout every journey.
Guests shall refrain from behaviour that:
- Endangers themselves or others.
- Disturbs wildlife.
- Damages the environment.
- Causes offence to local communities.
- Disrupts other Guests.
- Damages accommodation or equipment.
The Company reserves the right to terminate services immediately where a Guest's conduct is considered dangerous, unlawful, abusive or disruptive.
Any resulting costs shall remain the responsibility of the Guest.
8.3. Conservation and Environmental Responsibility
Ondjila Safaris Namibia CC is committed to responsible tourism and the long-term conservation of Namibia's natural heritage.
Guests are encouraged to support this commitment by:
- Respecting protected areas.
- Remaining on designated roads and tracks.
- Avoiding littering.
- Conserving water and energy.
- Respecting local customs and traditions.
- Supporting ethical wildlife viewing practices.
- Refraining from purchasing products derived from endangered species.
Our commitment to sustainable tourism forms part of every safari experience we design.
8.4. Photography and Drone Usage
Guests are welcome to photograph Namibia's extraordinary landscapes and wildlife for personal use.
Commercial photography or filming may require prior approval from the relevant authorities, conservation agencies or property owners.
The operation of drones is prohibited in many protected areas, national parks, private reserves and around wildlife.
Guests are solely responsible for obtaining any required permits and complying with applicable aviation and conservation legislation.
The Company accepts no responsibility for confiscated equipment, fines or penalties arising from unauthorised drone use.
8.5. Guest Safety
Guest safety remains our highest priority.
All Guests are required to comply immediately with instructions issued by:
- Professional guides.
- Drivers.
- Pilots.
- Lodge management.
- Rangers.
- Conservation officials.
- Emergency personnel.
Failure to comply with safety instructions may result in participation being terminated without refund.
The Company reserves the right to refuse participation in any activity where a Guest's behaviour places themselves, staff, wildlife or other Guests at risk.
8.6. Children
Children are warmly welcomed on many Ondjila Safaris Namibia itineraries.
Parents or legal guardians remain fully responsible for the supervision, conduct and safety of minors throughout the journey.
Certain lodges, charter operators or safari activities may impose minimum age restrictions.
These restrictions are determined by individual Suppliers and must be respected.
Parents acknowledge that safari environments contain inherent risks and agree to supervise children at all times.
8.7. Alcohol and Intoxicating Substances
Guests are expected to consume alcoholic beverages responsibly.
Participation in activities while under the influence of excessive alcohol or illegal substances may present significant safety risks.
The Company reserves the right to refuse participation in any activity where intoxication is suspected.
No refund shall be payable where participation is denied on safety grounds.
9.1. Health Requirements
Guests are responsible for ensuring they comply with all health regulations applicable to their journey.
Depending on the destinations visited, these may include:
- Vaccination requirements.
- Yellow Fever certificates.
- Malaria prevention.
- COVID-19 or future communicable disease regulations.
- Medical screening requirements.
- Health declaration forms.
Guests are encouraged to consult their medical practitioner or travel health clinic before confirming travel arrangements.
The Company cannot accept responsibility for changes to international health regulations implemented after a booking has been confirmed.
9.2. Medical Conditions
Guests have a duty to disclose any medical condition, disability, reduced mobility, allergy or dietary requirement that may reasonably affect their travel experience or require special arrangements.
Such information enables the Company to make reasonable efforts to accommodate individual needs.
Failure to disclose relevant medical information prior to travel may limit the Company's ability to provide appropriate assistance.
The Company reserves the right to decline participation in certain activities where medical conditions may present a safety risk to the Guest or others.
9.3. Fitness for Travel
Certain safari experiences involve travelling through remote wilderness areas where immediate medical facilities may not be available.
Guests confirm that they are physically and mentally fit to participate in the activities included within their itinerary.
Activities may include:
- Extended vehicle travel.
- Uneven terrain.
- Walking safaris.
- Scenic flights.
- Boat excursions.
- Climbing steps.
- Exposure to high temperatures.
- Remote locations.
Guests participate voluntarily and acknowledge the physical demands associated with such activities.
9.4. Comprehensive Travel Insurance
Ondjila Safaris Namibia CC strongly recommends that every Guest obtains comprehensive travel insurance immediately upon confirmation of their booking.
Appropriate travel insurance should provide cover for, at minimum:
- Trip cancellation.
- Trip interruption.
- Medical expenses.
- Emergency medical evacuation.
- Repatriation.
- Personal liability.
- Loss or theft of baggage.
- Delayed baggage.
- Travel delays.
- Missed departures.
- Personal accident.
- Adventure activities where applicable.
The Company may request proof of travel insurance prior to departure.
Should a Guest elect not to obtain adequate insurance, they do so entirely at their own risk.
9.5. Emergency Medical Evacuation
Many safari destinations within Namibia are located in remote regions where specialist medical facilities are not immediately accessible.
Emergency evacuation by road or air ambulance may be necessary in certain circumstances.
The costs associated with emergency evacuation can be substantial.
Unless specifically included within the Guest's travel insurance policy, all evacuation costs shall remain the responsibility of the Guest.
The Company accepts no financial responsibility for medical evacuation expenses.
9.6. Medication
Guests requiring prescription medication are responsible for ensuring they carry an adequate supply for the duration of their journey.
Medication should be transported in original packaging together with any supporting medical documentation where required.
The Company cannot guarantee access to replacement medication whilst travelling in remote areas.
9.7. Pregnancy
Guests who are pregnant are advised to consult their medical practitioner before travelling.
Certain airlines, charter operators and activity providers may impose restrictions relating to pregnancy.
The Guest remains responsible for ensuring compliance with any medical or operational restrictions applicable to their itinerary.
9.8. Food Allergies and Dietary Requirements
Ondjila Safaris Namibia CC will gladly communicate dietary preferences and food allergies to accommodation establishments and Suppliers.
However, meals are prepared by independent establishments, and the Company cannot guarantee the complete absence of allergens.
Guests with severe allergies are encouraged to discuss their requirements directly with accommodation providers upon arrival.
The Company shall not be liable for allergic reactions arising from meals prepared by independent Suppliers.
10.1. Assumption of Risk
Guests acknowledge that travel within Namibia, particularly in wilderness areas, involves inherent risks beyond the control of the Company.
These risks include, but are not limited to:
- Wildlife encounters.
- Remote travel.
- Uneven terrain.
- Weather conditions.
- Road hazards.
- Aviation risks.
- Mechanical failures.
- Illness.
- Injury.
- Delayed emergency assistance.
By participating in the itinerary, Guests voluntarily accept these inherent risks.
10.2. Guest Acknowledgement
By confirming a booking, each Guest confirms that they:
- Have carefully read these Terms and Conditions.
- Understand the nature of safari travel.
- Accept the inherent risks associated with wilderness tourism.
- Accept responsibility for obtaining appropriate insurance.
- Agree to comply with all lawful instructions issued by guides, pilots and Suppliers.
- Accept responsibility for their own conduct throughout the journey.
This acknowledgement forms an integral part of the booking agreement between the Guest and Ondjila Safaris Namibia CC.
10.3. Limitation of Liability
Ondjila Safaris Namibia CC acts as a professional travel designer and booking facilitator, arranging travel services on behalf of Guests through carefully selected independent Suppliers.
Whilst every reasonable effort is made to ensure that all services are delivered to the highest possible standard, the Company cannot guarantee the performance of independent Suppliers and shall not be held liable for any act, omission, negligence, delay, default, insolvency or breach of contract committed by any third-party Supplier.
To the fullest extent permitted by the laws of the Republic of Namibia, the Company's liability for any claim arising from a booking shall be limited to the amount paid directly to Ondjila Safaris Namibia CC for the specific service giving rise to the claim.
Under no circumstances shall the Company be liable for any indirect, consequential, incidental, special or punitive damages, including but not limited to:
- Loss of enjoyment
- Loss of income
- Loss of business opportunities
- Emotional distress
- Travel disruption
- Additional accommodation costs
- Missed connections
- Exchange rate losses
- Reputational damages
Nothing contained in these Terms and Conditions excludes liability where such exclusion would be unlawful under applicable legislation.
10.4. Indemnity
The Guest agrees to indemnify, defend and hold harmless Ondjila Safaris Namibia CC, its owners, directors, employees, consultants, guides, representatives and authorised agents against any claims, actions, liabilities, losses, damages, costs or expenses arising directly or indirectly from:
- The Guest's negligent or unlawful conduct.
- Failure to comply with these Terms and Conditions.
- Failure to follow lawful safety instructions.
- Personal injury caused by the Guest's own actions.
- Damage to property belonging to Suppliers or third parties.
- Claims brought by fellow travellers arising from the Guest's conduct.
This indemnity shall survive completion of the journey.
10.5. Force Majeure
Neither the Company nor any Supplier shall be deemed in breach of these Terms and Conditions where performance is prevented or delayed by circumstances beyond their reasonable control.
Such circumstances include, but are not limited to:
- Natural disasters
- Floods
- Wildfires
- Drought
- Earthquakes
- Severe weather
- Epidemics
- Pandemics
- Government restrictions
- Border closures
- Political instability
- Civil unrest
- Terrorism
- Labour strikes
- Industrial action
- Mechanical failures
- Air traffic restrictions
- Wildlife incidents
- National emergencies
- Utility failures
- Cyber incidents affecting operations
- Any other unforeseeable event beyond reasonable control
Where a Force Majeure event occurs, the Company will make every reasonable effort to minimise disruption and, where possible, arrange suitable alternatives.
Any refunds, credits or rebooking options shall remain subject to the policies of the relevant Suppliers.
11.1. Privacy and Protection of Personal Information
Ondjila Safaris Namibia CC respects the privacy of every Guest and is committed to safeguarding personal information.
By making a booking, Guests consent to the collection, processing, storage and use of personal information necessary for the administration of their travel arrangements.
Personal information may include:
- Full names
- Contact details
- Passport information
- Nationality
- Emergency contact information
- Dietary requirements
- Medical information voluntarily disclosed
- Payment information
- Travel preferences
Personal information will only be shared with Suppliers where necessary to fulfil booked services or where required by law.
The Company will take reasonable administrative and technical measures to protect personal information against unauthorised access, misuse or disclosure.
11.2. Confidentiality
All personal information provided by Guests shall be treated as confidential unless disclosure is required:
- By law;
- By a competent court;
- By government authorities;
- To facilitate booked travel services;
- To protect the safety of Guests or employees.
The Company will never knowingly sell Guest information to third parties for marketing purposes.
11.3. Intellectual Property
All itineraries, travel proposals, photographs, written descriptions, quotations, branding, logos, promotional material and documents produced by Ondjila Safaris Namibia CC remain the intellectual property of the Company unless otherwise agreed in writing.
Guests may not reproduce, distribute or commercially use Company material without prior written consent.
12.1. Personal Belongings
Guests remain responsible for the safekeeping of their personal belongings throughout their journey.
This includes:
- Passports.
- Cash.
- Jewellery.
- Cameras.
- Mobile devices.
- Laptops.
- Binoculars.
- Travel documents.
The Company accepts no responsibility for loss, theft or damage to personal belongings unless directly caused by proven negligence on the part of the Company.
12.2. Lost Property
Where personal property is left behind at accommodation establishments, vehicles or activity locations, the Company will make reasonable efforts to assist in recovering such items.
Any costs associated with storage, packaging, insurance or courier services shall be borne by the Guest.
Recovery of lost property cannot be guaranteed.
12.3. Gratuities
Gratuities remain entirely at the discretion of each Guest.
Many of Namibia's hospitality professionals rely upon gratuities as recognition for exceptional service.
Where appropriate, the Company may provide recommended tipping guidelines; however, these are intended as guidance only and are not compulsory.
12.4. Currency and Personal Expenses
The official currency of Namibia is the Namibian Dollar (NAD), which is accepted interchangeably with the South African Rand (ZAR) within Namibia.
Guests are encouraged to carry a combination of:
- Bank cards
- Limited cash
- Alternative payment methods where available
The availability of banking facilities and automated teller machines may be limited in remote regions.
Personal expenses remain the responsibility of the Guest.
12.5. Communications
Mobile network coverage and internet connectivity may be limited or unavailable in remote wilderness areas.
Guests should anticipate periods without telephone reception or internet access.
Such interruptions form part of the authentic safari experience and are beyond the Company's control.
12.6. Electrical Supply
Namibia operates on a 220–240 Volt electrical supply using Type D and Type M plug configurations.
Guests travelling from other regions should ensure they carry appropriate travel adapters and charging equipment.
The Company cannot guarantee uninterrupted electricity supply in remote areas where power may be generated by solar or backup systems.
12.7. Water Conservation
Namibia is one of the driest countries in sub-Saharan Africa, making responsible water usage essential.
Guests are kindly requested to support conservation efforts by:
- Limiting shower duration.
- Reusing towels where practical.
- Reporting water leaks.
- Avoiding unnecessary water consumption.
Responsible use of natural resources forms part of our commitment to sustainable tourism.
12.8. Lost or Damaged Property
Guests remain responsible for their personal belongings throughout the duration of their journey.
The Company cannot accept responsibility for:
- Lost luggage.
- Forgotten possessions.
- Theft.
- Damage caused by airlines or other Suppliers.
- Damage resulting from normal travel conditions.
Any claims should be reported immediately to the relevant Supplier and, where appropriate, to the Guest's travel insurer.
13.1. Complaints Procedure
Ondjila Safaris Namibia CC is committed to delivering exceptional service and encourages Guests to communicate any concerns promptly.
Should a Guest experience any difficulty during their journey, they are requested to notify the Company or the relevant Supplier immediately so that reasonable efforts may be made to resolve the matter during travel.
Complaints submitted only after completion of the journey may limit the Company's ability to investigate or remedy the matter.
Any formal complaint should be submitted in writing within fourteen (14) days of the conclusion of the itinerary and should include all relevant supporting information.
The Company will acknowledge receipt of the complaint and endeavour to provide a written response within a reasonable period.
13.2. Governing Law
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Namibia.
Any dispute arising from or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the competent courts of Namibia.
Where appropriate, both parties agree to attempt to resolve disputes amicably through negotiation before commencing legal proceedings.
13.3. Severability
Should any provision contained within these Terms and Conditions be found to be invalid, unlawful or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain valid and enforceable.
The invalid provision shall be interpreted as closely as possible to reflect its original commercial intention while remaining legally enforceable.
13.4. Entire Agreement
These Terms and Conditions, together with the confirmed quotation, itinerary, invoices and any written amendments agreed between the parties, constitute the entire agreement between Ondjila Safaris Namibia CC and the Guest.
No verbal representation, promise or statement shall vary these Terms and Conditions unless confirmed in writing by an authorised representative of the Company.
13.5. Amendments to these Terms and Conditions
Ondjila Safaris Namibia CC reserves the right to amend or update these Terms and Conditions from time to time.
The version applicable to a Guest's booking shall be the version in force on the date the booking is confirmed unless otherwise agreed in writing.
Updated Terms and Conditions will be made available upon request and may also be published on the Company's official website.
13.6. Acceptance of Terms and Conditions
By paying a deposit, making full payment, signing a booking confirmation, accepting a quotation or instructing Ondjila Safaris Namibia CC to proceed with a reservation, the Lead Guest confirms that:
- They have carefully read and understood these Terms and Conditions.
- They accept these Terms and Conditions on behalf of themselves and all members of their travelling party.
- They have the authority to bind all travellers included within the booking.
- All travellers agree to comply with these Terms and Conditions throughout the duration of the journey.
These Terms and Conditions become legally binding upon confirmation of the booking.
